When you schedule a charter or use our Service, you consent to abide by these Terms. Should you not agree with any section of these terms, then you are not permitted to use the Service.

2. Service Overview

OakRiverStudio offers an array of yacht charter services, such as:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

Service availability is subject to change, dependent on weather and other factors. We retain the right to adjust or cease services at our discretion.

3. Booking and Reservations

3.1 Booking Process

For a successful charter reservation, you need to:

  • Attain at least 18 years of age
  • Supply truthful and complete details
  • Make the necessary deposit as detailed in your reservation confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A booking is considered confirmed only after payment has been made and you receive our written acknowledgment. We hold the authority to decline service to any individual as we deem fit.

3.3 Availability

Charter scheduling is contingent upon availability of vessels and appropriate weather conditions. We’ll try our best to accommodate your preferred schedule.

4. Payment Terms

4.1 Pricing

Prices are quoted in € and are inclusive of relevant taxes unless indicated otherwise. Pricing is subject to alterations without prior notification.

4.2 Payment Schedule

  • Deposit: 50% of the total cost of the charter is due at the time of reservation
  • Balance: Must be paid 48 hours before the departure of the charter
  • Other charges (if applicable): Due after the charter concludes

4.3 Payment Methods

We accept major credit cards, electronic bank transfers, and certified cheques. Our secure, encrypted systems manage payment processing.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours prior to departure: Full refund except for processing charges
  • Between 24-72 hours before departure: 50% of the total refundable
  • Under 24 hours before departure: No refund provided

5.2 Weather Cancellations

If the captain deems weather conditions as unsafe, we’ll propose to either:

  • Reschedule the charter to another suitable date without extra cost
  • Offer a full refund if rescheduling isn’t an option

5.3 Mechanical Problems

Should there be mechanical issues with the allocated vessel, we’ll aim to supply an equivalent substitute. If that’s not possible, a full refund will be provided.

6. Safety and Conduct

6.1 Safety Obligations

Every passenger is required to:

  • Adhere to all directives from the crew
  • Use safety equipment when necessary
  • Disclose any medical conditions that might impact their safety
  • Stay within the specified areas on the boat

6.2 Restricted Items

The following are not allowed onboard:

  • Glass bottles
  • Illegal materials
  • Weapons or firearms
  • Excessive amounts of beverages (beyond moderate consumption)
  • Pets (unless they have been pre-approved)

6.3 Behavior

Passengers are expected to behave in a mannerly fashion. We may end a charter prematurely with no refund if a passenger’s actions pose a danger or spoil the experience for others.

7. Liability and Insurance

7.1 Our Responsibility

Our accountability is confined to the sum paid for the charter. We are not liable for:

  • Injuries due to passenger carelessness
  • The loss or destruction of personal belongings
  • Indirect or consequential loss, or punitive damages
  • Delays resulting from weather or events beyond our control

7.2 Insurance

Our comprehensive marine insurance protects our boats and operations. All passengers ought to have their own travel and personal insurance.

7.3 Risk Acceptance

Engaging in our yacht services signals your acknowledgement of the inherent risks involved with maritime activities and you take on the responsibility for your own protection.

8. Itinerary Modifications

We have the power to alter itineraries, paths, or timetables on account of weather, safety, or operational demands. Efforts will be made to offer alternatives of comparable value.

9. Force Majeure

We shall not be deemed responsible for hindrances, cancellations, or changes brought about by forces beyond our control, inclusive but not limited to:

  • Extreme meteorological phenomena
  • Natural calamities
  • Government decrees
  • Harbor shutdowns
  • Vessel breakdowns

10. Privacy and Protecting Your Information

We process your personal data in line with our Privacy Policy. Utilizing our services signifies your agreement to our collection and employment of your data as outlined in our Privacy Policy.

11. Proprietary Rights

All materials on our website, like texts, visuals, logos, and pictures, are safeguarded by copyright and proprietary laws. Unauthorized reproduction, distribution, or derivative creation is prohibited without our explicit consent.

12. Law and Jurisdiction

These Terms are subject to the laws of Germany. Disputes will be adjudicated in the courts of Hamburg, Germany.
